The patent abroad is not the same as the one carried out in Brazil. The report presented to the INPI, which guarantees the granting of the patent, is only valid in our territory, and only establishes the rights to the invention of Oiapoque to Chuí. Crossing borders, it’s no longer worth anything and this is one of the reasons why you should hire a patent specialist: so you don’t run the risk of seeing foreigners getting rich with dollars, euros and pounds at the expense of their work.
Overseas Patent: When Should I Care About It?
Whoever puts a product on the market needs, before the first sale, to surround himself with all the protection possible and safety involves planning. Today, you don’t even dominate your neighborhood market. But think long-term: Does your product have the potential for global reach? Even if it takes a few years for this to happen, can it be successful in other countries?
If the answer is yes, you should click here and schedule a meeting with Iplatam. Because its technology has to be protected before it becomes popular and anyone can come to Brazil, buy the product, study it and launch it under another name anywhere in the world. Ever heard of reverse engineering? It is the technique of taking a product apart and analyzing its details to understand how it works. That’s what they’ll do with your technology if you haven’t filed a patent abroad.
Patent abroad: in which countries should I apply for a deposit?
This answer depends on factors such as the characteristics of your invention and who the target audience is. Large companies file patents in every country on the planet, and Iplatam has already commanded this extremely complex operation for some brands. The problem is that this is very expensive, and it is unfeasible for someone who is just starting out and doesn’t have huge working capital.
Our tip: Protect your invention in the world’s leading economies such as the United States, Germany and Japan and also in some countries where it is likely to succeed. If your product is related to surfing, you don’t have to worry about Bolivia, because there is no sea there. But you must register in places like Australia, Indonesia and the Philippines.
What is needed to file a patent abroad?
In this other article, we tell you how a patent specialist works. To be able to file a patent abroad, it is practically the same thing. All documents will have to be translated and some will still have to be validated by the competent bodies in the country where your company intends to operate. It is a complex job, which should not be done without the advice of experienced professionals.
What are the deadlines for filing a patent abroad?
One of the possibilities is to follow the rules established by the Paris Convention (CUP), an international intellectual property agreement signed in 1883 and still in force. After filing the patent in Brazil, the company has another 12 months to do the same in other countries. In nations that are not included in your order within this period, the invention will be unprotected and may be used by any other company.
The other path is to follow the Patent Cooperation Treaty (PCT), where the procedures are different and the deadline is more flexible. This agreement is administered by WIPO / WIPO (World Intellectual Property Organization) and has about 150 signatory countries, including Brazil. Using this route, the patent application can be made simultaneously in several nations.
So the PCT is better than the Paris Convention?
Not necessarily, because these benefits cost more money. Iplatam experts recommend the Paris Convention to clients if they already have a clear idea of the countries in which they want to exploit the patent. That way, they’ll cut to the chase and spend less money. Now, if they are still not sure what the export focus will be, it is better to use the PCT, invest more financial resources and ensure global protection.
